Under the Indian Gaming Regulatory Act (IGRA), states may only be involved in Indian gaming under the terms of a strong tribal gaming compact. State involvement is limited to games agreed to in the compact and Class III games and areas, and does not extend to Class II gaming areas.

In the case of the Pokagon Band of Potawatomi Indians' gaming compact with the State of Michigan, the Michigan Gaming Control Board serves as the state compliance agency for gaming-related issues at tribal gaming operations in Michigan.

The tribe does not currently maintain a compact with the State of Indiana for tribal gaming operations. Currently, only Class II gaming is offered at Four Winds Casino in South Bend, Indiana.

On January 1, 2019, the National Indian Gaming Commission (NIGC) granted the Pokagon Band of Potawatomi Indians a Certificate of Self-Regulation. Under the Indian Gaming Regulatory Act (IGRA) and NIGC regulations (25 C. F. R. Part 518), self-regulatory status allows tribes to regulate Class II gaming with reduced oversight by the NIGC. The Commission will only issue a certificate of self-regulation to tribes that can demonstrate that they meet the applicable requirements, including triennial reviews to ensure that their gaming activities comply with IGRA, NIGC, and tribal laws and regulations. At the time, the Pokagon Band was the first tribe in Michigan and the fifth tribe in the nation to be awarded a certificate of self-regulation.

How can an individual voluntarily exclude themselves from the Four Winds Casino?

You may choose to voluntarily exclude yourself at any time by contacting the casino management or the Pokagon Gaming Commission and completing a "Voluntary Exclusion" form. An initial voluntary exclusion is permanent. However, you may apply for reinstatement to the Pokagon Gaming Commission Band after (2) years. A second voluntary exclusion will automatically result in your being placed on the Commission's involuntary exclusion list and you will be permanently banned from all Four Winds Casinos. How do I lift my voluntary exclusion to return to Four Winds Casino?

Once an individual has been voluntarily excluded for the first time and has completed a minimum waiting period of two years, they may apply to the Pokagon Band Gaming Commission for “reinstatement of exclusion.” Individuals who are voluntarily excluded for a second or subsequent time are permanently disqualified and are not eligible for reinstatement.

The written request must include the individual’s first and last name, date of birth, current mailing address, and a phone number to be used only to resolve questions. The letter must state that you are requesting reinstatement of the exclusion.

In addition, if the individual has been issued a Notice of No Entry Event (NOFE), they must remove the NOFE from the casino. See below for more information regarding casino NOFEs.

Once you submit your request, you must wait for a written response from the Pokagon Band Gaming Commission, as submitting a request is not the same as an approval. Therefore, until that response is received, the individual will remain blocked and prohibited from entering Four Winds Casino.

What is an involuntary exclusion?

An involuntary exclusion is when a person is barred and denied entry to Four Winds Casino premises by the Pokagon Band Gaming Commission. An involuntary exclusion does not require the consent of the person being barred and may be permanent.

An involuntary exclusion is issued by the Pokagon Band Gaming Commission for inappropriate or illegal conduct, conduct that may affect the integrity of the games (such as cheating or theft), conduct that endangers the safety of patrons and/or casino employees, or violations of federal or tribal gaming regulations.

In accordance with regulatory requirements, an involuntary exclusion is issued because an individual who has been voluntarily excluded more than once is permanently excluded.

What is the difference between a voluntary exclusion, an involuntary exclusion, and a Notice of No Entry (NOFE)?

Both an exclusion and a NOFE prohibit the listed person from entering or leaving all Four Winds Casino facilities, including hotels, restaurants, and all events. Inadvertent exclusions are usually permanent.

Voluntary exclusions are issued by the Gaming Commission, which independently regulates Four Winds Casino. Yes, a customer who is not satisfied with the Casino Administrator's resolution of a customer dispute regarding the operation or outcome of a game may file a customer complaint with the Pokagon Band Gaming Commission. Does the Gaming Commission regulate sports betting conducted at Four Winds Casino?

Yes, as with other forms of gambling conducted at Tribal gaming operations, the Pokagon Band Gaming Commission exercises extensive regulation over the conduct and operation of sports betting at Four Winds Casino.
