Since 1992, the Professional and Amateur Sports Protection Act has banned all sports betting in most parts of the United States. Five sports leagues then sued to block it, so then-Governor Chris Christie filed suit in the U. S. Supreme Court, arguing that PASPA violated states' rights under the Tenth Amendment. Oral arguments were held in December 2017, and the justices favored New Jersey's position. On May 14, 2018, the court ruled that PASPA was unconstitutional and therefore struck down because it violated the principle of "counterproductivity."

As a result, New Jersey finally overcame this hurdle and followed Nevada into sports betting.

Results in other states

Initially, there was concern that SCOTUS would choose a partial decision that would leave parts of PASPA in place and allow sports betting only in New Jersey. In that case, one other state would be burdened with a long process of fighting its own court battle along the same lines.
